ROGERS WIRELESS CHARMING COMMUNICATOR CONTEST RULES
Rogers Wireless Inc.
  1. Contest starts at 12:00 am Eastern Standard Time ("EST") on October 30, 2006 and continues until 5:30 pm EST on November 19, 2006, the Contest Closing Date. No purchase necessary.
    1. To enter,
      • send a text message containing the contestant number of your favorite "Miss Chinese Contestant" using your Rogers Wireless SMS-enabled device to short-code 888 before the Contest Closing Date. Need help sending a text message? Just visit us at www.rogers.com/textmessaging to find out how. Regular text messaging charges of $0.15 per message sent or according to your price plan will apply. Each text message sent and received will count as one (1) entry into the contest draw.
      • To enter without sending a text message, legibly handwrite your name, address, day/evening telephone number(s), date of birth (for verification purposes only) along with the contestant number of your favorite Miss Chinese Contestant. Mail your submission with sufficient postage to The ROGERS WIRELESS CHARMING COMMUNICATOR CONTEST, c/o Fairchild TV, 35 East Beaver Creek Road, Unit #8, and Richmond Hill, Ontario, L4B 1B3 to be received on or before the Contest Closing Date, as determined by postmark. Alternatively, you can send your submission by fax to 905-882-7120 (Toronto Area) or 604-295-6686 (Vancouver) to be received on or before the Contest Closing Date, as determined by time stamp. One (1) entry per envelope or fax per person per day.
    2. A random draw by a representative of Rogers Wireless Inc. ("Rogers") from all entries received for the winning contestant of Rogers Miss Charming Communicator Award will be made at approximately 12:00 noon EST on November 21, 2006 at Rogers' offices at One Mount Pleasant Road, Toronto, Ontario M4Y 2Y5. Selected entrants will be contacted by phone at the number listed on the entrant's Rogers account, or at the number from which the text message entry originated, or at the number listed on the mail-in or fax entry.
    3. If a selected entrant cannot be reached by November 28, 2005, incorrectly answers the skill-testing question, declines the prize, or fails to return a Release of Liability and End User Agreement as specified below, another entrant will be selected.
    1. Participants are eligible to win one (1) Motorola V3 wireless Phone Package valued at approximately $600, including one (1) Motorola V3 phone plus 3 months free local airtime service, text and picture messaging, voicemail, call display, call forwarding and busy/no answer transfer, group calling, call waiting, and navigate mobile internet for the same period of three (3) months, up to a maximum of $50/month. The activation on the Rogers network, the System Access Fee and the 911 Emergency Service Access Fee are included for the same period of three (3) months. Long distance and roaming charges, directory assistance plus all additional options and charges (plus applicable taxes) used/incurred by the winner and not specifically mentioned as part of the Phone Package are at the winner's costs. Winner must comply with Rogers' Wireless Consumers Terms and Conditions. Winner is solely responsible for advising Rogers of his/her decision to continue or to cancel the service with Rogers after the 3-month period and will be responsible for all charges incurred beyond this 3-month period. If the winner continues the service after the 3-month period, he/she might be required to sign the Rogers Wireless Service Agreement.
    2. Prizes must be accepted as awarded and may not be transferred or exchanged. Rogers reserves the right to substitute a prize of at least equal value in the event of the unavailability, for whatever reason, of the advertised prize.
  2. To be declared a winner, selected entrants must first correctly answer, unaided, a time-limited, mathematical skill-testing question, posed by telephone at a mutually convenient time; and may also need to return a signed release of liability, acknowledgment form. In the event the selected entrant is a minor, the entrant's parent or legal guardian will be deemed to be the entrant who must meet all contest eligibility requirements and who may accept the prize on behalf of the minor. Contest judges' rulings are final and without appeal in all matters related to the promotion and the awarding of prizes.
  3. By entering this contest, entrants consent to the use of their entry, name, address and/or any photograph of or that may be taken in publicity carried out by Rogers and/or its advertising agencies, without further notice or compensation.
  4. This contest is open only to residents of Canada, excluding residents of Quebec, who are over the age of 13, except employees of Rogers, its/their parent and affiliated companies, representatives, dealers and agents, contest suppliers and judges, and those with whom they are domiciled. The contest is subject to all applicable federal, provincial and municipal laws and regulations.
  5. No communications will be entered into except with selected entrants.
  6. Odds of winning depend on the number of eligible entries. All entries that are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of the rules may be disqualified by Rogers. Rogers takes no responsibility for lost, stolen, delayed, damaged, misdirected, late or destroyed entries, or for typographical or other production errors; nor is Rogers responsible for any errors or omissions in printing or advertising this contest. All entries become the property of Rogers and will not be returned.
  7. Rogers is collecting personal data about entrants for the sole purpose of administering this Contest. No further informational or marketing communications will be received by entrants unless entrants provide Rogers with explicit permission to do so. Please see Rogers' Privacy Policy at www.rogers.com for information on its policy towards maintaining the privacy and security of user information.
  8. By entering this Contest, entrants release and hold harmless Rogers, its advertising and promotional agencies and the contest judge(s), its affiliates and respective directors, officers, owners, partners, employees, agents, dealers, representatives, successors and assigns (collectively the "Releasees") from any liability in connection with this Contest or, if declared a winner, the prize. Before being declared a winner, entrants may be required to sign and return, within a stipulated period of time, a Declaration of Compliance with the Contest Rules, End User Agreement, and a full Liability and Publicity Release. By accepting a prize, winners consent to the use of their name, place of residence, voice, statements, and photographs or other likenesses for publicity, advertising or informational purposes in any medium or format without further compensation or notice.
  9. This contest will be run in accordance with these rules, subject to amendment by Rogers. Contestants must comply with these rules, and will be deemed to have received and understood the rules by participating in the contest. The terms of this contest, as set out in these rules, are not subject to amendment or counter-offer, except as set out herein.
    1. Rogers assumes no responsibility for failure of the internet or the website during the promotional period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any email or traffic congestion on the internet or at any website, or any combination thereof including any injury or damage to an entrant's or any other person's computer related to or resulting from playing or downloading any material in the promotion. Rogers reserves the right, in its sole discretion, to cancel or suspend the email portion of this contest should a virus, bug or other cause beyond their reasonable control corrupt the security or proper administration of the contest. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws. Should such an attempt be made, Rogers reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
    2. If the identity of a text messaging entrant is disputed, the authorized account holder of the Rogers wireless account from which the text message was submitted at the time of entry will be deemed to be the entrant. The individual assigned to the Rogers wireless account from which the text message was submitted is considered the authorized account holder. A selected entrant may be required to provide proof of being the authorized account holder of the Rogers wireless account associated with the selected entry. All text messaging entries must be submitted from a valid Rogers wireless account that may be identified by sending a reply text message. The sole determinant of time for the purposes of receipt of a valid entry in this contest will be the Rogers wireless network.
